First of all, please make sure you have the latest version of WordPress and update your hosting server PHP version to minimum 5.6.25 or newer. ***It’s Recommended***

Moreover, you need to uncheck the canvas menu http://prntscr.com/lz8xrh for your primary menu. However, you could select any menu to show as the off-canvas menu. In mobile, the selected canvas menu will show below the primary menu as the primary menu shows in the off-canvas in the responsive devices.
You could check out our theme live demo http://themelooks.us/demo/virtusky/wordpress/ as a reference to understand the logic/theme. In the desktop, there has an off-canvas menu that is different to the primary menu and in the mobile, the off-canvas menu shows below the primary menu.

Please Note: This is just a simple CSS issue and your 2nd issue was a setting issue that you have mentioned in your refund request and that will be fixed just uncheck an option. However, that was not an issue of the theme that’s a feature of the theme.
